DMCA Policy

Aback Tools respects the intellectual property rights of others and responds promptly to notices of alleged copyright infringement.

Introduction

Aback Tools respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our website or services. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide us with the information outlined below.

Filing a DMCA Complaint

To file a notice of copyright infringement, you must provide a written communication to our designated agent that includes the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest.
  2. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material on our website.
  4. Your contact information, including your address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the above information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Counter-Notification

If you believe that material you posted on our website was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. Your counter-notification must include the following information:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  3. A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Aback Tools may be found, and that you will accept service of process from the person who provided notification of the alleged infringement.

Upon receipt of a valid counter-notification, we will promptly forward a copy to the party who filed the original DMCA complaint. If the original complainant does not file a court action within 10 business days, we may restore the removed material.

Repeat Infringers

In accordance with the DMCA and other applicable law, Aback Tools has adopted a policy of terminating access for users who are deemed to be repeat infringers, in appropriate circumstances. Aback Tools may also, at its sole discretion, limit access to the website or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
